HOW TO ENTER:
Win Your Choice Of DeMarini Slow Pitch or Fast Pitch Softball Bats ("Sweepstakes") begins on January 3rd, 2009 and ends on March 2nd, 2009 ("Sweepstakes Period").
Each day of the Sweepstakes Period is defined by Eastern Time ("ET").
To enter, access The SOFTBALLSAVINGS.COM web site at http://www.SOFTBALLSAVINGS.COM ("Web
Site") which will take you to the Sweepstakes entry form and home
page ("Sweepstakes Home Page"). "Contestants" must
completely fill out the information requested on the user signup form
and then click "ENTER". Entry form requires your name, zip
code, and email address. There is a limit of one (1) entry per household.
PRIZE/ODDS OF WINNING: One Grand Prize: Grand
Prize consisting of a DeMarini White Steel Comp / Alloy SP Softball Bat OR DeMarini Vendetta C6 Comp Fast Pitch Bat. No substitution, transfer, or cash equivalent for prize, or prize
component, except that Sponsors at their sole discretion may substitute
a prize, or prize component, of comparable value due to prize, or prize
component, unavailability for any reason. It is the sole discretion
of the "Web Site" as how, when, and the quantity per shipment
of the "Sweepstakes". Any depiction of prize is for illustrative
purposes only. (Total Approximate Retail Value: $325). Odds of
winning prize depend on the number of eligible entries received during
Sweepstakes Period.
PLEASE NOTE: Taxes and all other expenses not identified as included
in the prize(s) are the sole responsibility of the Prize winner(s).
Prize(s) may not be transferred, sold, substituted or redeemed for cash
except at Sponsor's sole discretion due to prize unavailability, and
then only for a prize of equal or greater value.
WINNER SELECTION: Prize winner(s) will be determined on the basis
of a random drawing. The drawing will be conducted on or about March 3rd, 2009. All winner selection procedures shall be conducted
by Sponsor whose decisions are final with respect to all aspects of
the sweepstakes.
NOTIFICATION: Winner will be notified via email. The winner must
respond to said notification with 5 business days of date of notification,
or the prize will be forfeited. The name of the final Prize winner may
be obtained after June 2, 2009 by sending a self-addressed stamped
envelope to SOFTBALLSAVINGS.COM, Win Your Choice Of DeMarini Slow Pitch or Fast Pitch Softball Bats Winner's List, 8851 E. 34th St. N.,
Wichita, KS. 67226.
GENERAL: This sweepstakes is subject to all federal, state, and
local laws. Void where prohibited. The winners agree that Sponsor and
SOFTBALLSAVINGS.COM and their respective parents, affiliates and
their agents and employees shall not be liable for injury, loss or damage
of any kind resulting from participating in this contest or from the
acceptance or use of any prize awarded. Sponsor reserves the right to
verify eligibility qualifications of any winner. If, in Sponsor's sole
opinion, there is any suspected or actual evidence of electronic or
non-electronic tampering with any portion of this sweepstakes, any violation
of these Official Rules, or if technical difficulties compromise the
integrity of the sweepstakes, Sponsor reserves the right to terminate
the contest and conduct a random drawing to award the prize(s) or none
of them, using all entries received as of the End Date. Any attempt
to damage the content or operation of this sweepstakes is unlawful and
subject to legal action by Sponsor or their agents.
LIMITATIONS OF LIABILITY: Sweepstakes Entities are not responsible
for late, lost, damaged, misdirected, incorrectly addressed, incomplete,
illegible, undeliverable or destroyed entries resulting from any reason,
including: any hardware or software failures of any kind; lost or unavailable
network connections; failed, incomplete or garbled computer or telephone
transmissions; typographical or system errors; problems or technical
malfunction of any telephone network or lines, computer online systems,
servers, providers or computer equipment; or technical problems or traffic
congestion on the Internet, at a Website, or any combination thereof.
Sponsor and SOFTBALLSAVINGS.COM are also not responsible for any
injury or damage to entrant's or any other person's computer related
to or resulting from playing the Sweepstakes, downloading any material
for the Sweepstakes or other telecommunications malfunctions which may
limit an entrant's ability to participate. Sponsor and SOFTBALLSAVINGS.COM may prohibit you from participating in the Sweepstakes or winning
a prize, if in their sole discretion they determine you are attempting
to undermine the legitimate operation of the Sweepstakes by cheating,
hacking, deception, or other unfair playing practices or intending to
annoy, abuse, threaten or harass any other players or Sponsor and SOFTBALLSAVINGS.COM representatives. If, for any reason, this Sweepstakes
is not capable of running as planned, including infection by computer
virus, bugs, tampering, unauthorized intervention, fraud, or any other
causes beyond the control of Sweepstakes Entities which corrupt or affect
the administration, security, fairness, integrity or proper conduct
of the Sweepstakes, Sponsor and SOFTBALLSAVINGS.COM reserves the
right at its sole discretion to cancel, terminate, modify or suspend
the Sweepstakes. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY
DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES
MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT
BE MADE, SWEEPSTAKES ADMINISTRATOR RESERVES THE RIGHT TO SEEK REMEDIES
AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PARTICIPANT TO
THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
